Sexual abuse and sexual assault are uniquely delicate and complicated cases that are difficult to deal with for everyone involved. Often, victims are reluctant to come forward because they feel guilt, shame, or fear. In addition, sexual abusers are often trusted people of authority such as clergy, teachers, family members and friends of the family. Sexual abuse can include rape, sexual assault, improper touching and/or fondling. In addition to potential criminal penalties, victims of sexual abuse may be able to recover damages against both their abusers and that person’s employer if the employer had knowledge that would have permitted them to stop the abuse from happening.
Even if the sexual abuse occurred many years ago, you may still have a claim. Acts of sexual abuse often go unreported, sometimes for years. As a result, most states try to help victims by having a much longer time frame under which an adult can file a sexual abuse claim. However, there are still time restrictions for filing a claim; failure to file within the time frame may prevent you holding your abuser responsible forever.
