Under the False Claims Act in May 2016, a lawsuit issued allegations against 3M Company asserting the company knowingly sold and distributed defective combat earplugs to the U.S. Military from 2003 to 2015. The lawsuit further alleged that 3M knew about the design defect back in 2000.

3M, as a government and military contractor, received millions from the U.S. as payment for these earplugs. The earplugs were issued to service men and women who would potentially be exposed to continuing loud noises.

3M Combat Earplug Investigation

The U.S. Department of Justice (DOJ) investigation revealed that 3M combat earplugs were ineffective in blocking loud noises. In addition, the earplugs design was found to be too short to stay securely in place in a soldier’s ears. Due to the design defect, the earplugs were unable to properly protect the user’s ears, and our service men and women were putting themselves at risk for hearing loss/tinnitus.

In July 2018 as a result of a whistleblower lawsuit, 3M Company agreed to pay $9.1 million to the U.S. Military to resolve claims that they had knowingly sold defective earplugs to the military. Despite settling with the U.S. government, 3M never accepted liability for selling and distributing defective combat earplugs.
